Nicotine pouches are small, permeable,tea-bag like pouches which contain nicotine and other ingredients, including flavoring, sweeteners and plant fibers. The nicotine can either be extracted from tobacco or synthesized in a lab. These products are tucked into the lip and gum, releasing nicotine and flavorings to be absorbed by the mucous membrane of the mouth into the bloodstream. There is no need to smoke, chew or vape. As with other novel nicotine products such as e-cigarettes, nicotine pouches come with varying nicotine strengths and flavors.
 
As these products are a relatively new category of emerging products, regulations surrounding them are currently not comprehensive enough and showcase significant diversity across countries and regions. In many cases, these products are not covered by existing tobacco control laws or fall outside the regulatory framework, given the absence of tobacco.
 
Additionally, the widespread use of these products in recent years have aroused more and more public concern, mainly about its health impact and youth addiction. To address these issues, governments or policy makers in different countries have taken measures to regulate these novel products around production, sales, marketing, display, flavors, etc. As a result, the regulations for nicotine pouches keep changing or evolving.

U.S.

The earliest brand of nicotine pouches available in the U.S. is ZYN, which has been introduced into the market since 2014. Nevertheless, nicotine pouches in the U.S. were excluded from the tobacco products regulations before 2022 due to their lack of tobacco. In March 2022, the definition of Family Smoking Prevention and and Tobacco Control Act was amended, closing the synthetic nicotine loophole.
 
Under the amended law, tobacco products not only include products made from tobacco, but also cover products containing nicotine from any source, including synthetic nicotine. This means nicotine pouches fall into the category of commercial tobacco products and are subject to regulation by the Food and Drug Administration (FDA).
 
Manufacturers are then required to submit a Pre-Market Tobacco Application(PMTA) for each product SKU to attain a marketing granted order from FDA. As far as we learn, the agency has not issued a marketing grant order for any brand of nicotine pouches like Zyn, On!, and Velo till now, but allows them to continue selling their products temporarily until the final decisions are made.
 
While not prohibiting the sale of nicotine pouches, the FDA has been closely monitoring emerging trends of the market. For example, the agency found some retailers sold nicotine pouches to minors. In April 2024, the FDA announced that it issued 119 warning letters to, and filed 41 civil money penalty complaints against brick and mortar retailers for selling products to underage consumers.
 
Additionally, nicotine pouches legislation shows significant variations across states. For instance, Vermont bans online sales of nicotine pouches by U.S. retailers to Vermont customers, which is the most stringent regulation with regards to online sale of nicotine pouches, while other states, like New York and Minnesota, implement similar regulations on nicotine pouches to that of other tobacco products, such as high taxes and age limits of sale.
 

UK

Regulations of nicotine pouches in the UK are currently relatively “soft”. As nicotine pouches don’t contain tobacco, as defined in the Tobacco and Related Products Regulations (TRPR, 2016), they are not covered by these regulations. Instead, they fall under general consumer product safety regulations, which are less strict than the former ones.
 
Due to the regulatory gap, nicotine pouches are widely available for purchase in on-line shops and retail stores at present, and there is no age restriction of sale. It means that selling nicotine pouches to people under 18 years old doesn’t involve law breaking. Besides, there are no stringent regulations surrounding flavor, packaging, display or advertising of nicotine pouches.
 
Nevertheless, things may change in future. In December 2024, the UK government introduced the Tobacco and Vapes Bill. The Bill will ban or regulate the display, sale and advertising of all vapes and other nicotine products such as nicotine pouches.
 
For example, under the Bill, the advertising and sponsorship of all vapes and other nicotine products will be banned, and all vapes and nicotine products will be not allowed to sell to people under the age of 18. Additionally, the flavors, packaging and display of all vapes and other nicotine products may be regulated.
 
It is not clear whether the bill will be passed or not, or when the bill will be passed, while it can be seen that the regulations for nicotine pouches will be strengthened if the bill is passed.
 

Canada

Nicotine pouches are available for sale in Canada currently, and the government has been taking approaches to the regulations of them.
 
In July 2023, Health Canada authorized Zonnic pouches from Imperial Tobacco as a nicotine replacement therapy under the Natural Health Product Regulation.Nevertheless,there are no regulations regarding the display, sale and marketing of nicotine pouches. This makes them accessible to anyone, including people under the age of 18 and vulnerable groups.
 
Moreover, owing to the regulatory loophole, more unauthorized brands of nicotine flooded into the market and appeared in convenience stores and gas stations. Due to the richness of flavors, the discreteness and convenience in use and other factors, nicotine pouches are especially appealing to children and young people.
 
The prevalence of nicotine pouches among the youth raised growing concerns. The voices for regulating these products are increasingly high. For example, Canadian health experts urged Health Ministers to take action regarding the sale and marketing of flavored nicotine pouches. The proposals include reclassifying nicotine pouches as a prescription product, or to suspend the sale of nicotine pouches until the regulatory gap is closed, etc.
 
In response to the rising concern about nicotine pouches use among the youth, in August 2024, Canadian government implemented restrictions on nicotine pouches, aiming at curbing their appeal and accessibility, in particular to the youth. The measures, coming into effect on August 28, includes implementing strict advertising restrictions, prohibiting certain flavours and limiting sales to behind the counter at pharmacies.
 
For example, under the new regulations, nicotine pouches should be sold only by a pharmacist or an individual working under the supervision of a pharmacist. Additionally, other than mint or menthol, nicotine pouches in other flavors are prohibited to sell.
 
The new regulations reflect the government’s principles to protect the youth and non-smokers from the harmful effects of nicotine while aim to keep these products available for adult smokers who need them to help quit smoking.
 

EU

Currently, there is no EU framework to regulate nicotine pouches, and member states take different approaches to the regulations of these products.
 
In the EU, the legislative framework for tobacco control is called European Tobacco Products Directive (2014/40/EU), which came into effect in 2014 and has been implemented across EU Member States since 2016. The policy prohibits tobacco products for oral use. For example, the snus is banned across the EU, except in Sweden.
 
Nicotine pouches, while consumed orally, are currently not included in the EU-wide tobacco control policy due to their absence of tobacco and late emergence. This means there are no common EU-wide level regulations surrounding the manufacture, display, sale and advertising of nicotine pouches.
 
As nicotine pouches are widely spread in the EU internal market and raise increasing concern, member states have to take steps nationally and introduce regulations towards nicotine pouches on their own. As a result, member states have varying regulations for nicotine pouches,from entirely banning them to not regulating them at all.
 
Countries like Belgium and Netherlands have banned nicotine pouches since 2023. Besides, the French government announced in October its intention to ban nicotine pouches in the near future. Other countries like Denmark, Iceland, Norway and Sweden regulate them. Sweden, for example, implements regulations on age limits, health warnings, and ingredient lists of nicotine pouches. According to Euromonitor International, Sweden ranks the second largest nicotine pouches market, following the USA.
 
While nicotine pouches are now not covered by the tobacco Products Directive, it is possible that they will be regulated in the future in a revised Directive, as more and more member states are calling for stricter regulations for novel nicotine products across the EU.
 
For example, at the EPSCO (health) meeting held in June 2024, EU Health Ministers discussed two proposals submitted by Latvian delegation (on behalf of 10 Member States) and Danish delegation (representing 12 Member States), regarding tightening the EU-wide measures to prevent the youth from the harm caused by the novel tobacco and nicotine products. The proposals call for stricter regulations for flavor, nicotine content, marketing and sales of new tobacco and nicotine products.

Despite regulations in different countries varies, one key aspect that most regulations address is to safeguard against access to nicotine-containing products for underage users. Based on this priority, they maintain the accessibility for intended adult smokers who need nicotine pouches to quit smoking.
Looking ahead,as more and more countries begin to take actions, or are considering new regulations on nicotine pouches regarding their manufacture, sale, presentation, advertising and other things, it is possible that regulations around nicotine pouches may become comprehensive in the near future and be subject to similar regulations with other novel nicotine products like e-cigarettes.
